1. Acceptance and Agreement
By using or subscribing to the Q-Chef platform, you agree to be fully bound by these Terms and Conditions. If you do not agree to any provision of these terms, please stop using the platform.
These terms apply to:
- Restaurant owners subscribed to the platform
- Guests using payment and digital menu services
2. Description of Service
Q-Chef provides an integrated suite including:
- Interactive digital menus via QR code
- Contactless digital payment system
- Bill splitting among guests
- Analytics dashboards and sales reports
- Multi-language support
- Integration with point-of-sale (POS) systems
3. Registration and Account Creation
Registration Requirements for Restaurant Owners:
- You must be an adult (18 years or older) or a legal representative of the company
- Provide accurate and correct information upon registration
- Maintain the confidentiality of login credentials and bear full responsibility for account activity
- Notify us immediately if you suspect any security breach of your account
Prohibited Actions:
- Creating fake or misleading accounts
- Sharing login credentials with unauthorized parties
- Using the platform for illegal purposes
4. Subscriptions and Payments
Subscription System:
- Service begins with a free 30-day trial with no credit card required
- After the trial period, you will be asked to choose an appropriate subscription plan
- Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date
Billing:
- Subscription fees are charged in advance (monthly or annually depending on the chosen plan)
- All prices exclude applicable local taxes
- In case of late payment, we reserve the right to suspend the account until outstanding amounts are settled
Refund Policy:
- A full refund can be requested within 7 days of starting a paid subscription
- No refunds for expired months or services already used
- Exceptional cases are reviewed individually by the support team
5. Payment Processing
- All payments are processed through secure gateways compliant with PCI DSS standards
- Credit card data is not stored directly on our servers
- Order amounts are transferred to the restaurant's account according to the agreed settlement schedule
- Transactions are subject to payment processing fees as stated in the subscription plan
- Q-Chef is not responsible for payment errors caused by third parties (banks, payment networks)
6. Use of Digital Menus
- Accuracy of published information (prices, ingredients, item availability)
- Clear indication of food allergy triggers
- Compliance with local food regulations and legislation
- Not publishing misleading or unlawful content
Q-Chef reserves the right to remove any content that violates these terms without prior notice.
7. Intellectual Property
Q-Chef Ownership:
All platform elements including design, code, logos, and trademarks are the exclusive property of Q-Chef and protected under intellectual property laws.
Restaurant Content:
Q-Chef grants a limited, non-exclusive license to host restaurant content (images, menus, prices) solely for the purpose of providing the service.
Prohibited Actions:
- Copying the platform or any part thereof, or obtaining the source code
- Creating similar products based on Q-Chef technologies
- Using the Q-Chef trademark without prior written permission
8. User Obligations
- Using the platform for illegal or fraudulent activities
- Attempting to breach platform security or gain unauthorized access
- Uploading viruses or malware
- Violating the privacy rights of others
- Obstructing or disrupting the operation of the platform
9. Disclaimer and Warranties
Q-Chef services are provided according to availability. We do not guarantee:
Q-Chef is not liable for indirect losses or consequential damages arising from use of the platform or its unavailability.
10. Limitation of Liability
In all circumstances, Q-Chef's liability to any client shall not exceed the total fees paid during the three months preceding the incident in dispute.
11. Termination of Service
By the Client:
Subscriptions may be cancelled at any time from the control panel. The service remains available until the end of the paid subscription period.
By Q-Chef:
We reserve the right to terminate service or suspend an account immediately in cases of: violation of these terms, fraudulent or suspicious activity, repeated non-payment, or harm to the interests of the platform or its other users.
Upon termination, the client may request an export of their data within 30 days of the cancellation date.
12. Third-Party Services and Integrations
The platform may integrate with third-party services (payment gateways, POS systems, delivery services). These integrations are subject to the terms and policies of those parties, and Q-Chef is not responsible for their performance or reliability.
13. Amendments to Terms
- A notification will be sent via email at least 14 days before any material changes take effect
- Continued use of the platform after the amendment constitutes implicit acceptance of the new terms
14. Governing Law and Dispute Resolution
These terms are governed by the laws of Kuwait. In the event of any dispute, the following steps shall be taken in order:
- Direct contact with the support team for an amicable resolution
- Mediation through an agreed neutral party
- Recourse to competent courts if an amicable resolution is not possible
